The International Criminal Court (ICC) Prosecution has formally requested the dismissal of former President Rodrigo Duterte's bid to appeal the court's decision confirming charges against him related to alleged extrajudicial killings during his tenure as Davao City mayor and as president.
Prosecution Argues Lack of New Grounds
In a 12-page document dated May 4, the Prosecution submitted to the ICC Pre-Trial Chamber I that Duterte's appeal offers no new arguments and is merely based on disagreement with the court's ruling. The Prosecution emphasized that the defense's interpretation of the decision, particularly regarding the charges, is erroneous.
Court's Thorough Deliberations
The Prosecution noted that the court had thoroughly discussed the case details and heard arguments from both sides before issuing its decision. It also criticized statements made by Duterte's legal team in the media, which allegedly called the ICC "biased" and "self-serving." According to the Prosecution, lawyers are expected to adhere to the Code of Conduct, yet such remarks continue to undermine the court's integrity.
Impact on Witnesses and Victims
The Prosecution specifically cited former presidential legal counsel Salvador Panelo, who reportedly spread similar arguments in Philippine media, including claims that the ICC is "trying to justify its existence." The Prosecution warned that such statements could intimidate witnesses and victims, potentially deterring them from participating in the proceedings.
In April, the ICC Presidency had already constituted the Trial Chamber that will handle Duterte's case, preparing for a formal trial on allegations of crimes against humanity.
