Victim and Incident Details
The victim has been identified as Ivan Serintas Avila, a 35-year-old resident of Visitacion Street in Cebu City. According to the investigation conducted by the Traffic Enforcement Unit of the Cebu City Police Office, which relied on CCTV footage, both Avila and the racing motorcycles were heading toward the downtown area. As Avila made a left turn onto Solon Drive, tragedy struck.
The pursuing motorcycle, operated by Dendril Montehermoso, 21, with an 11-year-old backride passenger named Dember Maravilla from Upper Kawayanan, Barangay Sambag 2, counterflowed and collided with Avila's vehicle. The impact was so severe that it caused both riders to be thrown from their motorcycles, with Avila sustaining fatal injuries.
Immediate Aftermath and Medical Response
Due to the force of the collision, Avila died on the spot after suffering grave head and bodily trauma. Meanwhile, Montehermoso and the 11-year-old passenger were swiftly transported to the Cebu City Medical Center for treatment. At the hospital, they underwent mandatory liquor and drug testing as part of the standard investigative protocol.
In a surprising development later that same day, at around 1:00 PM, another individual involved in the crash voluntarily surrendered at the Barangay Hall of Sambag 2. This driver, identified only by the alias "J," is a 16-year-old resident of Sityo Lower Kawayan, B. Rodriguez Extension, Barangay Sambag 2.
Investigation Findings and Legal Proceedings
CCTV evidence revealed that J was operating a Yamaha Mio MXI with plate number GD23679, which returned to the scene of the accident before quickly fleeing. During his surrender, it was discovered that the minor was driving without a valid license, adding another layer of negligence to the case.
Dendril Montehermoso is currently under hospital arrest and will face charges of Reckless Imprudence Resulting in Homicide and Damage to Property. The 16-year-old alias J is undergoing the discernment process in accordance with Republic Act No. 9344, also known as the Juvenile Justice and Welfare Act of 2006, which governs how minors are handled within the legal system.
This tragic event highlights the dangers of reckless driving and illegal racing on public roads, prompting calls for increased traffic enforcement and public awareness campaigns in Cebu City to prevent similar incidents in the future.
