The Land Transportation Office (LTO) has issued a critical clarification regarding vehicle inspections, stating that passing the noise test at Private Motor Vehicle Inspection Centers (PMVICs) does not guarantee immunity for motorists using modified exhaust systems. This announcement comes amid intensified enforcement efforts in Cebu targeting loud and illegally altered mufflers.

Recent Crackdown in Cebu Yields Significant Results

In a recent operation led by LTO Region 7, authorities impounded a total of 92 motorcycles across the cities of Cebu, Mandaue, and Talisay. The breakdown of impounded units includes 42 from Mandaue City, 34 from Cebu City, and 16 from Talisay City. This coordinated effort involved collaboration with local traffic enforcers and the Philippine National Police (PNP), aiming to reduce noise pollution and enhance road safety.

Understanding PMVIC Sound Level Testing Standards

Under LTO Memorandum Circular No. 2020-2240, PMVICs conduct sound level testing with a maximum allowable limit of 99 decibels measured while the engine operates between 2,000 and 2,500 rpm. However, the agency emphasizes that even if a modified exhaust does not exceed this decibel threshold, it does not automatically render the aftermarket muffler legal.

Legal Consequences for Violators

Motorists found with illegal modifications face severe penalties under Republic Act No. 4136. Violators can incur a minimum fine of P5,000, have their motorcycles impounded, and be required to replace the illegal exhaust on-site at the impounding facility. The LTO warns that riders remain subject to apprehension by LTO or PNP–Highway Patrol Group (HPG) personnel, regardless of PMVIC test results.

LTO Urges Compliance and Documentation

The LTO strongly advises motorcycle owners to adhere to modification policies and always carry essential documents, such as a Certificate of Road Safety from the manufacturer. This documentation helps verify that exhaust systems meet established standards, ensuring both regulatory compliance and public safety.
