Palace: Anti-Fake News Bill Must Protect Free Speech

In a recent statement from Malacañang, Palace officials emphasized that President Ferdinand R. Marcos Jr. backs an anti-fake news measure, but only under the condition that it strikes a careful balance between regulation and the protection of constitutional freedoms. The announcement came during a Palace briefing on Tuesday, where Presidential Communications Office (PCO) Undersecretary and Palace Press Officer Claire Castro addressed concerns about the proposed legislation.

President Marcos Advocates for Balanced Approach in LEDAC Meeting

Claire Castro revealed that President Marcos raised critical points during the latest Legislative-Executive Development Advisory Council (LEDAC) meeting. Among the 21 priority measures targeted for passage by June 2026, a bill against fake news and digital disinformation was included. However, the President stressed the need for a balanced framework to prevent unintended consequences on free speech.

"Ang sabi lamang po ng Pangulo… ay dapat pong balansehin… dahil baka po masagasaan iyong freedom of expression. Dapat mai-define mabuti kung ano po iyong sinasabi nating fake news at disinformation," Castro stated, translating to: "The President said it must be balanced because freedom of expression might be affected. There must be a clear definition of what we call fake news and disinformation."

Assurances Against Suppression of Dissent

When questioned about potential misuse of the bill to crack down on dissent or critical views against the government, Castro provided firm assurances. She affirmed that President Marcos is committed to upholding the rights of Filipinos, stating, "Hindi po hahayaan ng Pangulo na masagasaan ang anumang freedom of expression/freedom of speech ng ating mga kababayan," meaning "The President will not allow any violation of the freedom of expression or freedom of speech of our people."

This clarification aims to alleviate fears that such legislation could be weaponized to silence opposition or curb public discourse, highlighting the administration's intent to foster a healthy democratic environment.

Other Priority Measures in the Legislative Agenda

Beyond the anti-fake news proposal, President Marcos has prioritized several other key legislative items. These include:

  • Travel tax abolition to boost tourism and economic activity.
  • Online child protection measures to safeguard minors in digital spaces.
  • Bangsamoro elections to support regional autonomy and peace processes.
  • Political dynasty reform to address governance and electoral fairness.

Status of Anti-Political Dynasty Bill

Regarding the proposed anti-political dynasty bill, Castro noted that the President has not yet endorsed specific provisions. Congress is currently conducting public consultations to gather input and refine the proposal. Once lawmakers finalize their versions, Marcos will assess which one to support, ensuring alignment with broader democratic principles and public interest.
